Comer argued that staff have not shown Biden understood what was being signed in his final months in office.<\/p>\n
Speaking to Just the News, Comer pointed to frequent use of an autopen. \u201cIt\u2019s questionable whether or not it\u2019s legal to use an autopen on a legal document, but what\u2019s not questionable is if the President of the United States had no idea what was being signed with using the autopen in his name,\u201d he said. \u201cThen, you know, that\u2019s not legal. We could see criminal charges against some.\u201d<\/p>\n
Comer said the committee\u2019s findings might also be used to question some clemency grants, citing Biden\u2019s poor performance in the first 2024 presidential debate as raising doubts about his capacity. Biden left the race about a month later and endorsed Kamala Harris.<\/p>\n
\u201cI think at the end of the day, our investigation \u2026 could be used as evidence in trying to overturn some of those pardons and some of the executive orders, because the autopen was used so frequently \u2026 after that debate,\u201d Comer said.<\/p>\n

Former Harvard Law professor Alan Dershowitz told Just the News in March that such challenges would \u201cend up in court.\u201d He identified two issues: the type of document signed\u2014whether a pardon or a bill\u2014and the nature of the autopen itself.<\/p>\n
On legislation, Dershowitz noted the Constitution\u2019s language: \u201cIf he approves, he shall sign it.\u201d An autopen, he said, \u201cwould raise a real problem if he signed it by autopen, which is not a real signature.\u201d On pardons, the question would be whether Biden actually granted them or whether someone else applied the signature without his genuine approval.<\/p>\n

Biden\u2019s first debate of the 2024 cycle was widely described as halting and disoriented. Former Obama adviser David Axelrod said there was \u201ca sense of shock\u201d at how Biden opened the debate and that \u201cthe panic had set in.\u201d<\/p>\n
Republicans had long questioned Biden\u2019s mental acuity. Special Counsel Robert Hur\u2019s report on Biden\u2019s handling of classified documents described him as likely to present as \u201ca sympathetic, well-meaning, elderly man with a poor memory.\u201d Hur said Biden could not recall the years he served as vice president or the year Beau Biden died.<\/p>\n
Last month, Biden told The New York Times he \u201cmade every decision\u201d on pardons. Aides, however, confirmed he did not individually approve each name on categorical pardons.<\/p>\n
