{"id":722,"date":"2026-09-19T20:55:54","date_gmt":"2026-09-19T20:55:54","guid":{"rendered":"https:\/\/kpdaily.info\/?p=722"},"modified":"2026-09-19T20:55:54","modified_gmt":"2026-09-19T20:55:54","slug":"federal-appeals-court-sacks-trumps-trans-service-member-ban-sort-of","status":"publish","type":"post","link":"https:\/\/kpdaily.info\/?p=722","title":{"rendered":"(-) Federal Appeals Court Sacks Trump\u2019s Trans Service Member Ban \u2013 Sort Of"},"content":{"rendered":"<p class=\"isSelectedEnd\"><strong>Another day, another federal court ruling involving what critics of the Trump administration describe as activist judges and a politically charged challenge to President Donald Trump\u2019s military policies.<\/strong><\/p>\n<p class=\"isSelectedEnd\">On Monday, a federal appeals court ruled 2\u20131 that portions of the Trump administration\u2019s policy restricting transgender people from serving in the military were unlawful.<\/p>\n<p class=\"isSelectedEnd\">The court also concluded that the policy appeared to contain \u201canimus\u201d toward transgender people.<\/p>\n<p class=\"isSelectedEnd\">The court found that the policy was unconstitutional at this stage of the proceedings and stated that it \u201cappears to be driven by the bare desire to harm a politically unpopular group.\u201d It also described the policy advanced by Defense Secretary Pete Hegseth as \u201carbitrary and based upon animus.\u201d<\/p>\n<p class=\"isSelectedEnd\">\u201cThe record shows that the purpose of the Hegseth Policy is to target applicants and servicemembers who express what the Administration believes is a \u2018false gender identity,\u2019 and the Policy goes far beyond disqualifying persons currently or recently suffering from gender dysphoria,\u201d the decision states.<\/p>\n<p class=\"isSelectedEnd\">Here\u2019s another justification: The military has spent years working to combat sexual harassment and assault. Critics of the ruling argue that allowing transgender people to serve raises questions about military standards, readiness, and the policies governing personnel.<\/p>\n<p class=\"isSelectedEnd\">There is also a broader argument to consider: Military service is not a constitutional right that every person is automatically entitled to exercise. The armed forces impose numerous medical, physical, and professional standards on prospective and current service members.<\/p>\n<p class=\"isSelectedEnd\">What\u2019s next\u2014could courts be asked to determine whether people with diabetes or heart disease should be allowed to serve? Or whether physical standards unfairly discriminate against people who are overweight?<\/p>\n<p class=\"isSelectedEnd\">Those questions illustrate the broader debate over how much authority courts should have to review military personnel policies and how much deference should be given to military and executive officials.<\/p>\n<p>In any event, the appeals panel did <strong>not<\/strong> block the administration from enforcing its restrictions against people seeking to join the military.
