Those cases did not go to trial and are no longer pending.**

In August 2023, a federal grand jury in Washington indicted Trump on four felony counts tied to his effort to remain in office after losing to Joe Biden. The charges included conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and conspiracy against rights. Prosecutors alleged he and allies promoted false claims of election fraud, pressed state officials to change results, and tried to disrupt Congress’s counting of electoral votes on Jan. 6, 2021.

Trump denied wrongdoing. His lawyers argued the case criminalized political speech, official acts, and a president’s right to contest an election. The Supreme Court later ruled that presidents have immunity for official acts, narrowing what could be tried. After Trump won the 2024 election, special counsel Jack Smith moved to drop the federal case under longstanding Justice Department policy against prosecuting a sitting president. A Georgia racketeering case over the same period was dismissed in 2025.

As of 2026, those election-related prosecutions against Trump are closed. Related Jan. 6 cases against other defendants have also been dismissed or vacated after clemency and Justice Department requests in his second term. What remains is a public record of allegations, defenses, and unfinished litigation — not a live trial that will “draw the line” in court. The legal fight over 2020 is now political and historical, not a pending criminal verdict.

**Federal prosecutors once charged Donald Trump with trying to overturn the 2020 election.
